Welcome to YachtService.VIP, a digital platform connecting yacht owners with qualified, licensed contractors for yacht-related services, including maintenance, repairs, crew hiring, and more. Our mission is to provide a seamless, transparent, and trusted marketplace for yacht owners and service providers worldwide.

Your Agreement to These Terms
These Terms of Use (“Terms”) govern your access to and use of the YachtService.VIP website, services, and platform (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, Cookie Policy, Dispute Resolution Policy, and Contractor Licensing Policy. If you do not agree with these Terms or any referenced policies, please do not use the Platform.


1. Acceptance of Terms

Age and Legal Capacity
By using the Platform, you confirm that you are at least 18 years old or have the legal capacity to enter into these Terms with parental consent if under 18. You also confirm that you have the authority to enter into this agreement.

Binding Agreement
These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and YachtService.VIP, a Delaware limited liability company (“we,” “us,” or “our”). Your agreement is confirmed by checking the acceptance box during registration or by accessing the Platform.

Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.


2. Purpose of the Platform

Connecting Yacht Owners and Contractors
YachtService.VIP is a marketplace that connects yacht owners with licensed and qualified contractors for services such as yacht maintenance, repairs, cleaning, crew hiring, and other related services. We act as a facilitator, not a direct service provider.

Our Commitment to Quality
We are committed to transparency, quality, and trust by verifying contractor qualifications, requiring valid licenses, and providing clear guidelines for Users. However, we are not responsible for the services provided by independent contractors.


3. User Responsibilities

Accurate Information
You agree to provide accurate, complete, and current information when registering or using the Platform, including during account creation, service requests, or contractor profiles.

Lawful Use
You agree to use the Platform only for lawful purposes and in compliance with these Terms, applicable local, state, federal, and international laws, including maritime regulations.

Prohibited Activities
You agree not to:

  • Engage in fraudulent activities, misrepresent qualifications, or provide false information.
  • Use the Platform to post offensive, defamatory, or illegal content.
  • Attempt to interfere with the Platform’s functionality, including hacking or distributing malware.
  • Violate intellectual property rights, such as uploading copyrighted material without permission.
  • Engage in spamming, phishing, or other abusive behaviors.
    Violation of these Terms may result in account suspension or termination.

4. Contractor Licensing and Qualifications

Licensing Requirements
All contractors on YachtService.VIP must hold valid licenses and certifications relevant to their services, as required by applicable local, national, or international regulations (e.g., marine repair licenses, professional liability insurance).

Verification Process
We verify contractor credentials, including licenses, certifications, and insurance, within 3–5 business days of submission. An optional enhanced quality verification, including portfolio and reference checks, is available for $50 (included in Professional and Premium plans). User Responsibility to Verify Contractors
While we verify contractor credentials, you are responsible for confirming that a contractor’s qualifications meet your specific needs before hiring. We recommend reviewing licenses, ratings, and reviews.


5. Service Guarantees

Independent Contractors
YachtService.VIP facilitates connections between Users and independent contractors but does not perform services directly. Contractors are solely responsible for the quality and outcome of their work.

No Guarantees
We strive to ensure high-quality connections but do not guarantee the performance, results, or suitability of services provided by contractors. All services are provided “as is.”

Reviewing Contractor Agreements
Any guarantees or warranties for contractor work are subject to the specific agreements between you and the contractor. We advise reviewing these agreements carefully before engaging services.

6. Payments and Fees

Payment Structure
YachtService.VIP offers a Freemium plan and paid subscriptions (Professional: $50/month or $500/year; Corporate: $200/month or $2000/year for yacht owners; Professional: $100/month or $1000/year; Premium: $300/month or $3000/year for contractors). Contractors may also incur lead fees ($20–$50 per lead or 5–10% of service value for premium projects). For details, see our Pricing Page.

Payment Processing
Payments are processed through secure third-party providers (e.g., Stripe, PayPal). You are responsible for any applicable taxes, which may vary by state.

Refund Policy
Refunds for subscriptions are available within 14 days of purchase if no services have been used. Lead fees are non-refundable unless the lead is invalid. For details, see our Payment and Refund Policy.


7. Limitation of Liability

Scope of Liability
To the fullest extent permitted by Delaware law, YachtService.VIP, its affiliates, and employees are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Platform or services provided by contractors.

Types of Damages Excluded
This includes, but is not limited to, damages for loss of profits, data, business opportunities, or other intangible losses, even if we have been advised of the possibility of such damages.

Exceptions
Some jurisdictions, including certain U.S. states, may not allow certain limitations of liability. In such cases, our liability is limited to the maximum extent permitted by law.


8. Dispute Resolution

Resolving Issues
We encourage Users to resolve disputes directly with contractors. If unresolved, disputes related to the Platform will be handled through binding arbitration in accordance with our Dispute Resolution Policy.

Arbitration Process
Any disputes arising under these Terms will be resolved through binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association. You waive the right to participate in class actions or class-wide arbitration.

Governing Law
Arbitration and these Terms are governed by the laws of the State of Delaware.


9. Intellectual Property

Ownership
All content on the Platform, including text, images, logos, and software, is owned by YachtService.VIP or its licensors and is protected by U.S. and international copyright and trademark laws.

User Content
By uploading content (e.g., reviews, photos), you grant YachtService.VIP a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content on the Platform.

DMCA Policy
